Mata Nui Collectors Edition! Yay!

Are you referring to the Collector's Edition of the Mata Nui Online Game that SolisMagna.com will be releasing this summer?

So, how does the legal side of this project look? I imagine there's no problem selling 3d printed components and all, but how much leniency is there with the use of the Bionicle trademark and all that other jazz? Is the 'remastered game' made using the base flash files and all, or is it a reproduction of the MNOLG with original meshes/artwork/etc.?

I had thought about that too seeing that they would be making profit from the game. I'd imagine that it lego considers MNOG abandonware since they don't care about any of the downloads. Maybe Templar owns it which is why they could host it on their website and they have an agreement with them. Does anybody know when it will be released? I am simply dying to play it.

Oh and by the way, they are completely redoing the game. Remember how in the original game the sky and music and stuff was all low quality? Not anymore!

I figure I'll throw in my two cents, cause hey, no critique is for the weak.

 

In regards to the legality of "selling" a remastered MNOG with any form of Lego "set", it's totally, complete, 100%...

 

... Illegal.

 

MNOG was developed by Templar Studios, so they have their half of ownership by actually making the game. BIONICLE is owned by The Lego Group, so there is their half.

If anyone were to use their work, be it Lego's trademarks of Lewa, BIONICLE, Tahu, Takua, etc, in order to make a profit from it while not being in direct contract with Lego, it would be against the law. As far as the "MNOG Takua" goes, that I think would be okay, as BZP has seen many custom Bionicle parts sold, so it seems fine.

 

But a remastered MNOG, in a box, with Lego and Templar trademarks on it? I don't give a dang how "good" it looks "remastered", you're just asking for one of the two of them to come in and say "Yeah, you're done now."

 

I'm fairly sure Lego WOULD come in if they found out about this, given that regardless of it being "abandon ware", it is still theirs, and if they don't want LoMN getting out, what makes anyone think they'd want some fans making money off of a product that allowed Bionicle to take off so well?

 

The idea sounds good on paper, but if you honestly expect to make money off of this as though you actually made the game, or a portion off of it, then I'm sorry, but you need to pick up a law book.

 

... Or seek help. Quickly.

I would still buy it. I realized the second I first saw it that it would be illegal. So long as we keep this "quiet" I doubt that it will end in some huge legal issue. If lego did see it then they would probobly sue. The thing is though, I doubt this hasn't crossed the minds of the people in charge of the project, and I doubt that they would even attempt this unless they had some sort of deal going on. The fact that some former Templar employees are working with them shows that they must have an agreement. Still, lego is rather "stingy" with this sort of thing, just look at LOMN. If this gets canceled then I would probobly have some sort of brake down. :3

Agreed. Now I think it's okay for them to make custom bionicle sets that you can buy, seeing as others have done the same with just standard LEGO elements. But a full-scale game? The chances are too slim for that to happen. The only way of saving it would be if it became freeware or if it was down right canceled.

As Meso pointed out, BZPower is directly partnered with The Lego Group. So yeah, they're gonna find out soon enough.

 

Lego would first send a cease and desist order. If SM.com did not comply, then they'd sue. Or at least threaten to.

 

And trust me, if this hasn't crossed their minds after not only I, but another former member of their team told them multiple times, then I'd like them to refer to my prior post. I really, REALLY doubt they have ANY deal with Lego what so ever, because Lego would never allow this unless they were the one handling it.

 

Also, if Templar is working with them on this, then it's only music related. I doubt they have the time, and I also doubt they'd try and sell any version of it. I think they'd get in trouble as well.

 

Finally, if this causes you to have a "brake down", I'd advise visiting a car repair shop. =P

Assuming that they already have some form of permission from TLG and Templar, then I wouldn't really worry about the legality of this situation. Otherwise it probobly wouldn't be the smartest move in the world...

I don't know about that. LEGO once foxed a fanmade recreation of LEGO Uninverse one time and it was freeware. If they could take down something that was free to play, then they would have no qualms about ceasing a recreation of a famous BIONICLE game that you have to pay for.

PrismWind, I know you really are supportive of the Solis Magna group, but I don't think you should go by assumptions. I would suggest asking the person over the Mata Nui Collectors Edition project whether he/she has had permission from LEGO and/or Templar Studios. 

 

Plus, I don't think this should be in BIONICLE Discussion at all. It is not an official LEGO product and it is being made by fans.

We apologize for any confusion or outrage that the game might have spurned, and plan to cease work on the game and indefinitely cancel its release immediately.

 

EDIT: Please disregard the content as well as its supposed official nature. I made a mistake; sorry everyone. The MNOLG: CE will be released in full, as a paying product, as originally planned.

I hate to see a good fan project be ceased from development, but it's better to take the safe route than to be potentially sued by a big corporation like LEGO.

 but isn't that like when people commit crime or avoid paying their taxes and try to hide it from the authorities.......

 

Considering all that Bionicle (and thus Lego,) has done to keep our pleasant little community together, I think it's immensely disrespectful and not to mention dangerous to simply go ahead with monetising such a project and hope that nobody finds out, or nothing happens. I apologise if you were not actually advocating such a course of action.

 

Maybe this group does have a writ of permission from Lego to use their trademarks - I'm sure many of us here would like to see any kind of official proclamation. Else, the only way I see this being viable is to drop the sale of any explicitly labelled lego/bionicle content and just sell custom masks, which I'm sure are recognisable enough.

That's a shame. I hope that the major motivation for this project was not do$h but a love for our dear matoran universe.

 

Will you be releasing any resources etc. that you've worked on so far? Is it not possible to cobble together a remastered version using what you have already? I was under the impression that a release was very soon... and I don't think a free, fan project would incur any legal wrath.

I apologise if I was too subtle or misleading. What I was nudging at, was perhaps the possibility of you releasing your remastered version (if it is indeed as close to release as I've been led to believe,) for free to the community. Considering you wouldn't be monetising the content, I don't see a problem with it (unless you were actually using the MNOLG's files, which appear to be owned by Lego and Templar?)... that said, I'm no lawyer.

 

If that's not possible, or the game is too unstable as is, then that's fair enough. I was just hoping you might've wanted to share what you already have so that your work isn't left to rot and that the time spent on it wasn't a waste.

You don't need the $cash$,

For the project to smash

Expectations and be a success,

Just do it for the fun,

Why don't you just release it for free? Then at least your work isn't all gone. I'd hate to see another LOMN...

I don't think they would be allowed to release assets from a game that might have been illegal to produce. Plus, if you want LOMN so bad, why not make your own fanmade tribute to the game? I've seen that done before several times with MNOG and so far LEGO hasn't ceased them.

You can always learn how to make 3D games.

 

Plus, Mata Nui Collectors Edition wasn't authentic ether. It was being made by fans and it wasn't an official LEGO product.

But it was a recreation. I can do something like a point and click denture but not a 3D game. plus it takes a while to learn how to do that

Though it may take a long time to understand, it might be worth it in the long run. Just a suggestion you might want to consider.
