I've heard that the problem is essentially one of infrastructure. I don't think there's a searchable database of Swapnote messages, which could potentially get Nintendo into trouble if the FBI or a similar organization were to demand a record of messages that could contain illegal activity. I'm disappointed too, since while I very rarely exchanged notes with others I did enjoy the special notes from Nintendo. But that doesn't mean that Nintendo is overreacting by shutting it down, particularly since the infrastructure itself could be the problem.

Hopefully Nintendo hurries up and adds Miiverse to the 3DS as a replacement. Unlike Swapnote, that does maintain a record of interactions, and its arrival on 3DS is long overdue.

I suppose that's true. Doesn't make it suck any less.
