They were in the process of putting all the artifacts away though. I don't think Arty would use the Phoenix knowing someone else would have to die to save his own life. However I do think he had something in his pocket to help him...

yeah I'm not sure about the whole artifact thing, but I really don't think Arty's dead because since it was the finale, and he DID die, I really think they would have showed that, but they didn't.
